Welcome to DeployDrive (“we,” “our,” or “us”). By accessing or using our website, services, or content (collectively, the “Services”), you (“User,” “you”) agree to these Terms of Use (“Terms”). If you do not agree, please discontinue use of our Services immediately.
1. Description of Service
DeployDrive provides proxied and cached access to content (“Content”) stored on third-party cloud storage services, including, but not limited to Google Drive/OneDrive. When you make files public on your cloud storage and access them via DeployDrive, we may temporarily cache copies of that content on our servers to improve performance and availability.You acknowledge and agree that:
- You are solely responsible for any Content you make publicly accessible through your cloud storage.
- By using DeployDrive, you grant us a license to store, reproduce, and deliver your Content for the purpose of operating the Service.
- DeployDrive does not control third-party cloud storage services and does not guarantee the availability, security, or legality of the Content stored there.
- Cached copies of your Content may be removed at our discretion or in accordance with our retention policies.
- You are solely responsible for complying with the terms, policies, and guidelines of those third-party services.
- DeployDrive is not responsible for any actions, changes, restrictions, outages, or interruptions caused by or related to these third-party services, including how we interface with them.
2. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted here, and your continued use of the Services constitutes acceptance of the updated Terms. Changes to pricing or subscription terms will also be posted in advance.3. Intellectual Property and Third-Party Branding
All content, design elements, graphics, code, logos, trademarks, and other materials are the property of DeployDrive or its licensors and are protected by copyright, trademark, and other intellectual property laws.Our service integrates with third-party platforms such as Google Drive and Microsoft OneDrive. These are trademarks of their respective owners, and we are not affiliated with, endorsed by, or sponsored by these companies. Use of these platforms is subject to their own terms and policies.
You may not copy, modify, reproduce, distribute, or create derivative works of DeployDrive content without our express written consent.
4. User Content
You are solely responsible for all content you upload, publish, or share through our Services (“Content”).By submitting Content, you represent and warrant that:
- You own the Content or have all necessary rights, licenses, and permissions to share it.
- Your Content does not infringe upon or violate any intellectual property rights, privacy rights, or other legal rights of any third party.
- You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and display your Content solely for the purpose of operating and providing the Services.
- Your Content may be publicly accessible, and your account name may appear in URLs associated with your Content.
- We may remove or refuse to display any Content at our discretion if it violates these Terms or applicable laws.
5. Acceptable Use
You agree to use DeployDrive in a responsible manner and in compliance with all applicable laws and regulations. You agree not to:- Use the Services for any unlawful purpose or to facilitate illegal activities.
- Attempt to gain unauthorized access to DeployDrive systems, other users’ accounts, or any third-party services integrated with DeployDrive.
- Distribute malware, viruses, ransomware, spam, or any other harmful, malicious, or disruptive material.
- Store, transmit, or share content that is illegal, infringing, defamatory, pornographic, or violates third-party rights.
- Harass, abuse, threaten, intimidate, or harm other users, or engage in discriminatory or offensive conduct.
- Store personal data (passwords, SSNs, credit card numbers) without proper encryption.
- Interfere with, disrupt, or compromise the integrity, security, or performance of the Services or any connected third-party services.
- Use the Services to store, transmit, or share illegal, infringing, offensive, or otherwise prohibited content.
- Attempt to bypass usage limits, security measures, or access restrictions implemented by DeployDrive or any third-party service.
- Impersonate any person, entity, or organization, or misrepresent your affiliation with any person or entity.
- Use the Services in any manner that could damage, disable, overburden, or impair our servers, networks, or systems, or interfere with any other party’s use of the Services.
6. Third-Party Links & Services
Our Services may contain links to third-party websites or integrate third-party tools. We are not responsible for any content, services, or damages related to third-party sites.7. Warranty
For free users, our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, title, or non-infringement.For Paid Services, DeployDrive provides a limited warranty that:
- We will maintain 99% monthly uptime for core features (measured as total available minutes minus scheduled maintenance and force majeure events, divided by total minutes in the month).
- We will make reasonable commercial efforts to resolve technical issues within 48 hours of acknowledgment.
This warranty does not cover interruptions caused by:
- Your misuse, misconfiguration, or violation of these Terms
- Issues with third-party platforms (Google Drive, OneDrive, etc.)
- Force majeure events, internet outages, cyberattacks, or natural disasters
- Scheduled maintenance (with 24-hour advance notice when possible)
8. Limitation of Liability
To the fullest extent permitted by law, DeployDrive and its affiliates, employees, and partners shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, resulting from:- Your use of or inability to use the Services.
- Any third-party conduct, content, or services.
- Technical failures, security breaches, viruses, or system outages.
For Paid Services, DeployDrive’s total aggregate liability for any claim shall not exceed the greater of the fees you paid to us for the Services during the three (3) months immediately preceding the event giving rise to the claim.
The warranty described in Section 7 constitutes your sole and exclusive remedy for any service-related issues.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, such as liability for fraud, gross negligence, or willful misconduct.
9. User Data and Security
- Responsibility for Data
You are solely responsible for the security of any personal data you store or manage using DeployDrive, including but not limited to passwords, personal information of your users, or other sensitive data. For example, storing passwords in plain text is your responsibility. - No Liability for User Misconfiguration
DeployDrive provides tools to build websites and databases but does not control, access, or guarantee the security of user-configured databases or data stored on third-party services. We shall not be liable for any loss, theft, or unauthorized access to such data. - Recommended Security Practices
While we may provide guidance on best practices for securing your data, following such guidance is your responsibility, and failure to implement appropriate safeguards may result in data breaches. - Compliance with Laws
You agree to comply with all applicable data protection and privacy laws (e.g., GDPR, CCPA) when collecting, storing, or processing personal information. - Right to Suspend or Terminate
DeployDrive may suspend or terminate accounts that are reported or discovered to store sensitive data insecurely or violate applicable laws, to protect the safety and security of our platform and its users.
10. Indemnification
You agree to defend, indemnify, and hold harmless DeployDrive, its affiliates, employees, and partners from any claims, damages, losses, liabilities, costs, or expenses arising out of:- Your use of the Services.
- Your violation of these Terms.
- Your infringement of any intellectual property or other rights.
11. Privacy
Your use of the Services is subject to our [Privacy Policy], which explains how we collect, use, and protect your personal information.12. Termination
We may suspend or terminate your access to the Services at any time, for any reason, without notice. Provisions of these Terms that should survive termination (such as intellectual property rights, disclaimers, indemnification, and limitation of liability) will remain in effect. No refunds are provided if you are terminated for violating the Terms.13. Paid Services and Billing
- Paid Features
Some features of DeployDrive are available only with a paid subscription ("Paid Services"). By subscribing, you agree to pay all applicable fees as described at the time of purchase. - Billing and Payment
You authorize us (and our payment processors) to charge your selected payment method for fees associated with the Paid Services. Fees are due in advance and are non-refundable, except as required by law or as otherwise stated in these Terms. - Subscriptions & Renewals
If you purchase a subscription, it will automatically renew at the end of each billing cycle unless you cancel before renewal. You may cancel at any time via your account settings; cancellations will take effect at the end of the current billing cycle. - Price Changes
We may change our prices at any time. Any changes will take effect in the next billing cycle after notice is provided. - Taxes
You are responsible for all applicable taxes, fees, and charges imposed by any governmental authority.
